Terms and conditions for the use of the "Betsson WiFi" service (hereinafter referred to as "Terms and Conditions")
- The Internet Access Service "Betsson Wifi".
- The provision of the access service to the Internet network called "Betsson WiFi" (hereinafter the "Service") will be carried out by FanXP S.A., CUIT Nº 30-71747568-9, with address at Olga Cossettini Nº 1540, 5º piso, Departamento 604, Ciudad Autónoma de Buenos Aires, República Argentina (hereinafter, "FanXP"), on behalf of Betsson Malta Holding Limited - Casino de Victoria S.A. - Unión Transitoria, CUIT Nº 30-71727906-5, with address at Cerrito Nº 348, 4º piso, Departamento "A", Ciudad Autónoma de Buenos Aires, República Argentina (hereinafter, "Betsson").
- The protection of your privacy, as well as respect for the applicable responsible gaming guidelines, are extremely important to FanXP and to Betsson. For this reason, we recommend that you read these Terms and Conditions before accepting them and accessing the Service.
- In these Terms and Conditions, any reference to a User and/or Users shall be understood to refer to those human persons who use the Service. The Service is available within the facilities of the Alberto J. Armando Stadium, located at 805 Brandsen Street, in the Autonomous City of Buenos Aires, Republic of Argentina, also known as "Bombonera".
- These Terms and Conditions set forth the rules under which the Service may be accessed.
- General
- Access to the Service is voluntary. The access and/or use of the Service constitutes an express manifestation by each of the Users of their consent and unreserved acceptance of these Terms and Conditions.
- To access the Service, Users will be asked to indicate their age, having to select between the following ranges: (i) from 1 to 17 years old; or (ii) 18 to 99 years old.
- For adult Users, their e-mail address; their cell phone number; as well as a sworn statement regarding the non-existence of restrictions to access games of chance (hereinafter, "Restrictions") will also be requested. The Restrictions include any self-exclusion regimes in force in the Argentine Republic, whatever their denomination or governing body, as well as subjective prohibitions that may apply to the Users in accordance with the regulations in force.
- Betsson and/or FanXP may also require users of legal age to indicate their full name and surname, as well as their National Identity Document. These data will be used for the purpose of making checks against databases of self-excluded and/or banned persons, and/or who for any other reason are subject to Restrictions.
- Betsson is responsible for the processing of the personal data collected while FanXP is in charge of the processing, always under Betsson's instructions. No data will be collected from persons who identify themselves as minors.
- This Service is intended for human beings with full civil capacity. The use by minors is the sole responsibility of the parents, guardians or companions, who will be ultimately responsible for acceptance of the terms, as well as the uses that minors make of the content offered by this Service.
- The Terms and Conditions constitute the entire agreement between FanXP, Betsson and the User with respect to all matters set forth herein, superseding any prior or contemporaneous oral or written communications or proposals between the parties with respect to their subject matter.
- To access the Service, the User must accept the terms and conditions on a mandatory basis.
- The acceptance of the terms and conditions implies an express authorization of the User to FanXP and Betsson to communicate data of the User, or related to his/her use of the Service, to other entities of the Betsson group and/or to third parties with whom Betsson has agreements to send commercial communications. Additionally, by virtue of a legal imposition and/or requirement issued by a competent authority, FanXP and/or Betsson may communicate Users' data, or data relating to their use of the Service, to competent public bodies.
- Acceptance of these Terms and Conditions and a User's declaration that he/she is not subject to Restrictions implies consent to receive commercial communications. The User assumes full responsibility for the consequences arising from the falsity or inaccuracy of his or her affidavit as to the absence of restrictions. For such purposes, the User undertakes to hold harmless FanXP, Betsson and their respective representatives, directors and shareholders against any claims and/or administrative actions that may arise due to such inaccurate or false statements regarding the non-existence of Restrictions.
- Term and Duration
- The term of the Service shall commence upon acceptance by the User of the Terms and Conditions, and shall extend for the duration of the User's session in the facilities of La Bombonera.
- FanXP and/or Betsson may establish new conditions and/or modifications to any of the clauses contained in these Terms and Conditions.
- FanXP and/or Betsson may terminate the Service without cause, without prior notice and at any time, without giving rise to any right in favor of the User.
- FanXP and/or Betsson may temporarily or permanently suspend the Service without just cause, without prior notice, and without generating any right in favor of the User.
- Free Service
- The Service shall be provided free of charge to the Users who use it under the conditions established herein, within the facilities of the Bombonera.
- Conditions for the use of the Service
- The User shall be entitled to use the Service and shall be responsible for the content of all information transmitted, transferred, downloaded, published and/or stored through the network used.
- The Service may only be used for lawful purposes. The improper use of the Service is the sole responsibility of the User, responding civilly and criminally against the damages that could cause both FanXP and / or Betsson, as well as third parties. It is forbidden to use the Service as a result and/or with the purpose of carrying out an illegal, abusive, annoying and/or offensive activity, including: uploading and/or making available offensive content; committing and/or encouraging a crime; stalking and/or harassment; harassing and/or threatening and/or infringing in any way the rights of persons; disrupting or interfering with access to and/or use of the Service and/or the Internet and/or any network, computer or other devices; the uploading and/or transmission of a virus or other harmful component; defamation and/or interference with the service of other customers; the use, uploading, uploading, reproduction, transmission and distribution of material protected by copyright, commercial or intellectual property rights, without the prior and express authorization of the respective authors and owners of the works; to defame and/or for the publication and distribution of any defamatory, obscene material or material that constitutes a threat or contravenes good morals, public order and/or current legislation; the uploading and/or transmission of files containing software or other material containing viruses, Trojans, worms, exposure cancellation systems, corrupted files, or any other similar program or software that may damage the operation of third parties' equipment and/or FanXP and/or Betsson. Similarly, it is prohibited to create a false identity for the purpose of misleading third parties, use, download or otherwise copy or provide to third parties (whether for profit or not) any directory or user information of the Service and/or digital assets. Resale or redistribution of bandwidth or any other part of the Service for any purpose is strictly prohibited.
- The User is responsible for the correct use of the connection, being obliged to avoid any action that may damage systems, equipment; accessible services or websites, directly or indirectly through the Service and in accordance with the rules contained in this document. Notwithstanding the foregoing, the User declares to know and possess all the technical requirements necessary for the compatibility of the provision of the Service with its own equipment.
- The User acknowledges that FanXP and/or Betsson cannot exercise control over the content of the information that circulates through the network. For this reason, FanXP and Betsson are not and shall not be responsible for the contents that circulate through its network. Since the network made available to the User may be used to connect to other networks, the User agrees to comply with and abide by the acceptable use policies of such networks.
- The User accepts and acknowledges that the technical resources of the network are sized according to the speed and capacity of each type of service, therefore, the extreme use of the same may produce an excess over this sizing; therefore, the Service may be restricted in its use and the User must adapt its use. In case of detecting an abusive use of the network resources that affect or threaten the service of other Users, the service of such User may be suspended preventively or definitively as deemed appropriate, without generating any right in favor of the User. FanXP and/or Betsson are not obliged to provide, nor do they establish, any type of minimum speed and/or bandwidth quota for each User. The User agrees and acknowledges that for the use of the Service the speed and/or bandwidth allocated may be decreased and/or suspended at any time, without requiring the User's prior consent, and without giving rise to any rights in favor of the User. The User accepts and acknowledges that FanXP and/or Betsson may restrict access to certain urls, at its sole discretion and without requiring the User's prior consent, and without this generating any right in favor of the User.
- Breaches of security of networks, systems or websites on them are prohibited. Such actions may result in legal action by FanXP and/or Betsson against the perpetrators. i) Unauthorized access to data, resources, systems, websites or networks, any attempt to verify the existence of vulnerabilities, or the violation of security and authentication measures, through intrusion or obtaining passwords by any illegitimate means. ii) Unauthorized monitoring of data or traffic of any network or system without the corresponding authorization of the owner. iii) Interference with the service of any user, host or network, including, without limitation, mailbombing, flooding and denial of service (DoS) attacks. iv) Forgery of any TCP/IP protocol header or any information contained in email or newsgroup headers. v) Actions that could in any way damage, disable, overburden, impair or interfere with the use or enjoyment of any website, service or the networks connected to them.
- FanXP and/or Betsson do not guarantee any level of performance of the Service. The User understands and agrees that any content that may be accessed through the Service may be subject to network management in order to ensure that all users of the Services receive reasonable access to the Services.
- Limitations and Scope
- Since the provision of the Service also depends on resources and services contracted with third parties, both FanXP and Betsson disclaim any liability for damages or losses caused by events arising therefrom. FanXP and/or Betsson shall not be liable for routing and/or routing errors, loss of device information or data, delay in delivery or unplanned Service interruptions.
- Both FanXP and Betsson disclaim all responsibility for the quality, accuracy, reliability and correctness of the data, programs and information of any kind circulating on their networks (viruses, malfunctioning programs, improper use of software, etc.). The content of such information is the sole responsibility of the parties exchanging it (sender and recipient). Both FanXP and Betsson shall not be liable in case of use of the Service by unauthorized third parties.
- The User exonerates FanXP, Betsson and their respective representatives, directors and shareholders from any judicial and/or extrajudicial claim motivated by action or omission of the User, its clients, contractors, agents or employees, with respect to the use of the facilities, networks and/or telecommunications systems of third parties, in a manner not contemplated or expressly prohibited by this document; Also, FANXP CHILE SPA shall not be liable to the User for any damages and/or losses that any cause, including fortuitous events or force majeure, may cause to the equipment and/or facilities of the User and/or third parties.
- In no event shall FanXP or Betsson be liable for any damages, including, without limitation, direct, indirect, consequential, indirect damages, lost profits, or losses or damages of any nature whatsoever, whether or not in connection with the User's trade or business, arising in connection with the use of the Service or the inability to use the Service, in connection with any failure of performance, error, omission, interruption, defect, delay in operation or transmission, computer virus or device, line system failure, but not limited to.
- Neither FanXP nor Betsson control or guarantee the absence of viruses or other elements in the contents that may cause alterations in the computer system (software or hardware) or in the electronic documents and files stored in your computer system. When a User accesses the Service and/or digital assets, he/she does so at his/her own risk, and therefore accepts the terms and conditions of the Service.
- Neither FanXP nor Betsson will in any case be responsible for the behavior and/or contents of other websites that can be accessed from the Service, so it will be the User's responsibility to read the terms and conditions and privacy policies of each of them.
- Neither FanXP nor Betsson is responsible or can be held liable for the links and/or hyperlinks to other Internet sites of third parties during the registration and/or access to the Service, nor for the content and activities of such sites, and their existence does not imply that FanXP and/or Betsson approves or accepts their contents and/or services. Therefore, the User's visit or access to such sites is at the User's own risk.
- Obligations and Responsibility of the User
- The User undertakes to maintain the computer support necessary for access to the Service. The User assumes full liability to FanXP, Betsson and/or third parties for damages of any kind that may be generated as a result of his own actions, those of his dependents or third parties, linked to the Service; as well as those derived from the equipment, means or systems used by them, and the damages resulting from the non-observance of the laws or regulations, or from other illicit facts, and the User shall indemnify and hold harmless FanXP, Betsson, as well as their respective representatives, directors and shareholders before any claim that may correspond in the aforementioned assumptions.
- Jurisdiction
- In case of controversy, difference, disagreement or conflict arising from these terms and conditions, the User, FanXP and Betsson submit to the jurisdiction of the ordinary courts with jurisdiction in civil and commercial matters of the Judicial Department of San Isidro, of the Judicial Power of the Province of Buenos Aires, expressly waiving any other jurisdiction.
- Final Considerations
- Failure to exercise any of the powers or rights conferred by this instrument shall not constitute a waiver of any of the provisions hereof.
- Each clause of these terms and conditions is valid in itself and shall not invalidate the rest. The invalid or incomplete clause may be replaced by an equivalent and valid clause by agreement of the parties.
